Notice to Clerk of Court and Public Memorial

Travante-TyVaun: Tucker sui juris,
Plaintiff,
v.
CME LENDING GROUP LLC, DANIEL FOWLER, JAMES METCALF
Defendant.
Case No. 8:25-cv-1332
Public Memorial and Testimony under God Addressing an Endorsed Order (Docket entry 12-13)

In the presence of Almighty God and in the spirit of truth, justice, and liberty, I, the living man, endowed with God-given, inalienable rights, hereby make this testimony and memorial for the record, to be seen, heard, and known by all men, and to address the courts and all officers of the court with clarity and honesty.

1) Clarity in Docket Entries and the Duty of the Court

Let it be known that when addressing any docket entry, no ambiguity or presumption shall be allowed. The issue at hand must be clearly stated for all to see, and for all parties involved to understand. It is not enough to say, "it appears to be..."—this is not the language of truth, nor the language of justice.

I stand before you as a man, not subject to presumption, but as one who is endowed by his Creator with unalienable rights, secured by the Holy Bible, the Constitution of the United States, the Magna Carta, the Common Law, and the Maxims of Law. These are the foundations upon which I stand, and in these principles, I do not operate in presumption but in truth and justice for We The People. No matter the forum, whether before judge, clerk, or officer of the court, the truth must be the guiding principle.

2) The Right to Petition the Court and the Supremacy of the Constitution

It is a well-established fact that under the Constitution, every citizen has the right to petition the court for a redress of grievances. This is not a mere formality, but a fundamental right guaranteed by the supreme law of the land.

Further, 18 U.S.C. establishes that the United States is charged with ensuring that the people’s grievances are addressed. The courts are to be the servants of the people, not the other way around.

The Supremacy Clause of the Constitution mandates that no statute, rule, or code may supersede the law of the land. Therefore, it is both treasonous and dishonorable for any statute or rule—be it in the form of a regulation, fine, or fee—to be levied as a condition of access to the court. Such practices are void, as they stand in violation of the principles of law that govern this land. Any action taken to enforce such a statute is a violation of the Constitution and the rights it guarantees.

To ask for payment or impose a fee for access to the court is not only a denial of justice, it is a perversion of the very rights afforded to the people by the founding documents of this nation. In this regard, any such enforcement is null and void and cannot stand under the law.

3) To the Clerk and All Officers of the Court

To the Clerk of the Court, I say this: You are not above the law, and neither are you above your duty to act in accordance with the truth. You, too, as an officer of the court, are bound by the Constitution and the law. The actions you take, including entering false or misleading entries into the docket, are not only a violation of the rights of the people but also a violation of your own integrity.

Know this: It is a well-known fact that the system is built to confuse, delay, and obfuscate. This system seeks to keep the truth hidden from the people and restricts their access to justice. The act of misrepresenting or obscuring facts in the docket entries is a deliberate attempt to conceal the truth, to deceive, and to manipulate. This is unacceptable, and I will not stand idly by as these wrongs continue.

4) The Call for Truth and Justice for All People

As a living man, I stand with the people—We the People. I stand for truth, for justice, and for the preservation of our God-given rights. I call upon all judges, clerks, and officers of the court to remember their sacred duty. You are not the lords over the people, but their servants. The power vested in you by the people is not for your personal gain, nor is it to be used to deprive the people of their rights.

Know that no man or system can stand against the truth. The time will come when all deceit and injustice will be revealed, and when that time comes, the righteous will prevail. Until then, I call upon all who have the power to stand for justice, to take heed of their duties, and to uphold the law as it is written—without presumption, without partiality, and with full respect for the rights of all men.

May the truth prevail, and may justice be done for all people.
